Escrow Advantage, Inc. (“Escrow Advantage,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal and financial information you share with us. This Privacy Policy explains how we collect, use, disclose, and safeguard information about you when you use our escrow services, visit escrowadvantage.com (the “Site”), or otherwise interact with our Santa Clarita and Valencia branch offices.

This Policy is organized in two parts:

  • Part 1 — Notice to Escrow Customers, describing our privacy practices as a licensed California escrow company under the Gramm-Leach-Bliley Act (“GLBA”) and California’s Escrow Law.
  • Part 2 — Notice to Website Visitors and California Consumers, describing your rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”).
Escrow Advantage, Inc. is licensed as an independent escrow agent by the California Department of Financial Protection and Innovation (DFPI License No. 8631493 — Santa Clarita Branch; DFPI License No. 9631685 — Valencia Branch). We do not sell your personal information.

Part 1 — GLBA Privacy Notice for Escrow Customers

1. Information We Collect

In the course of opening and administering an escrow, we may collect nonpublic personal information about you from the following sources:

  • Information you provide on escrow instructions, applications, and related forms (e.g., name, address, Social Security number, date of birth, employment information);
  • Information about your transactions with us, our affiliates, or others (e.g., account balances, payment history, property information, wire instructions);
  • Information we receive from consumer reporting agencies, title companies, lenders, real estate agents, or other third parties involved in your transaction; and
  • Information you provide to us directly by phone, in person, by mail, or through our website contact form when initiating or discussing an escrow.

2. How We Use This Information

We use the information we collect to open, service, and close your escrow; to communicate with the parties, agents, and lenders involved in your transaction; to comply with California Escrow Law, DFPI regulations, and other legal or regulatory obligations; to prevent fraud; and to maintain the records required of a licensed escrow agent.

We do not disclose your nonpublic personal information to nonaffiliated third parties for their own marketing purposes.

4. Your Right to Limit Sharing

Because we do not share your nonpublic personal information with nonaffiliated companies to market their products or services to you, federal law does not require us to offer you an opt-out for that type of sharing — we simply don’t engage in it.

5. How We Protect Your Information

We maintain physical, electronic, and procedural safeguards designed to protect your nonpublic personal information, consistent with the FTC Safeguards Rule and DFPI recordkeeping and trust-fund handling requirements. Access to client information is restricted to employees who need it to service your escrow, and our staff are trained on confidentiality obligations.

6. Retention

We retain escrow files and related records for the period required under California Escrow Law and applicable DFPI regulations, after which records are securely destroyed. If you would like more information about our current record retention practices, please contact us using the information in Section 16 below.


Part 2 — CCPA/CPRA Notice for Website Visitors & California Consumers

The Site includes a contact form that allows visitors to submit certain personal information directly to us. Like most websites, the Site may also automatically collect certain limited technical information about your visit through our hosting provider, WordPress platform, and any plugins or embedded content in use, as described below.

8. Sources of Personal Information

We collect personal information directly from you when you submit our website contact form, or when you contact us by phone, in person, or by mail in connection with an escrow. We may also receive information from third parties involved in your transaction (e.g., your real estate agent or lender). Like most websites, the Site may also automatically generate limited technical information about visitors through our hosting provider, content management system, or embedded plugins.

9. How We Use Personal Information

  • To respond to inquiries submitted through our contact form;
  • To open, service, and close escrow transactions;
  • To maintain the security and proper functioning of the Site;
  • To comply with legal and regulatory obligations; and
  • To improve our services and Site content.

10. Do We Sell or Share Your Personal Information?

No. Escrow Advantage does not sell personal information, and does not “share” personal information for cross-context behavioral advertising as those terms are defined under the CCPA/CPRA.

11. Your California Privacy Rights

If you are a California resident, you have the right to:

  • Know what personal information we have collected, used, disclosed, and (if applicable) sold about you;
  • Delete personal information we have collected from you, subject to certain exceptions (e.g., information we must retain under California Escrow Law);
  • Correct inaccurate personal information we maintain about you;
  • Opt out of the sale or sharing of personal information (not applicable, as we do not sell or share);
  • Limit the use of sensitive personal information to what is necessary to perform our services; and
  • Not receive discriminatory treatment for exercising any of these rights.

12. How to Submit a Request

You may submit a request to know, delete, or correct your personal information by:

  • Submitting a request through our website contact form; or
  • Calling one of the branch phone numbers listed in our website footer and Section 16 below.

We will verify your identity before fulfilling your request, and will respond within the time frame required by California law (generally 45 days, extendable once by an additional 45 days with notice to you). You may designate an authorized agent to submit a request on your behalf, subject to verification.

13. Cookies and Similar Technologies

The Site may use cookies or similar technologies to operate and improve site functionality (e.g., through our WordPress hosting platform). These do not constitute a “sale” or “share” of personal information. You can control cookies through your browser settings.

14. Children’s Privacy

The Site is not directed to children under 16, and we do not knowingly collect personal information from children.

15. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. Material changes will be posted on this page.
